SAMPLE TEACHING CONTRACT IN JAPAN

The following is to be used as a general overview of a typical teaching contract for schools in Japan. Most aspects of the contract are usual and the norm. However, some aspects may differ from school to school, other aspects may be added by the school and or yourself during a contract negotiation. Make sure you understand all aspects of the contract and know that you may ask to change certain aspects through negotiation.

For any none agreements that may arise, established labour laws are the final word and not the contract.

This contract states that ____________________ known as the employer and __________________ known as the employee, entered into a contract by mutual agreement under the following conditions:

Employee Contractual Duties:
The employee shall work at __________________ or at locations decided by agreement with a ___________________ client, as a full-time foreign staff member.

Terms of Contract:
This contract is valid for 12 months from __ / __/ (year) to ___ / __ / (year).

Work Schedules and Remuneration:
The teacher will be required to teach up to five days per week. Any days between Monday and Friday (sometimes Saturday), depending on schools. Usually no more than 25 contact hours will be assigned per week. Monthly salary of (average) 250,000 yen will be paid each month.

Overtime
Overtime shall be paid at the rate of (usually) 2000 yen per hour for every contact or teaching hour worked over 25 hours per week.

Bonuses
Upon successful completion of this contract, eligible employees are entitled to a completion bonus of (usually) 100,000 yen.

Raises
Raises maybe offered (depending on the school) to employees who successfully complete a minimum 1 year working contract. Remuneration can be 1-3% of gross salary. Exact remuneration is determined by end of year review.

Office Hours and Other Duties
In addition to teaching hours, teachers are often responsible for keeping a certaina mount office hours per week, depending on the school type. Lesson planning, lesson notes and other office duties maybe performed during these hours.

Vacation
Employees will (usually) receive 2 weeks paid vacation. 1 week in August and 1 week during Christmas in addition to national holidays.

Training
Employees without former ESL experience (may often) complete 2 weeks of training to familiarize themselves with teaching materials and methods. Teachers may receive a certain pay amount per hour for all hours of training. Upon successful completion, teachers will be paid as a full time instructor.

Housing
In Japan teachers usually pay for their own apartments, often set up by the school. You may request a private apartment, not shared if you prefer. Try and view pics of the apartment if possible, via email. Teachers are responsible for all utilities. Teachers are responsible for returning apartment to its ‘original state’ upon finishing the teaching contract and will be deemed responsible for any and all unreasonable damages to the property. Schools reserve the right to deduct any and all expenses required in returning the apartment to it original condition.

Apartment Key Money
School (usually) agrees to paying all key money to the landlord in accordance with Japanese custom and law.

Visa Fees
School (usually) agrees to the payment for all fees associated with securing a working visa and sponsorship for the teacher.

Health Insurance Fees
Schools (usually) agree to pay premiums in full on employees behalf.

Work Attitude
The teacher will follow the policies in the school, rules and regulations, not showing up intoxicated, and act in a professional manor. (Also maybe a section on obeying local laws as well.)

Contract Cancellation
Refusal to follow school policy will be just cause for contract termination. Upon termination by employer Employee is entitled to payment for all days worked before the termination of said contract. Both employer and employee agree to providing 1 month written notice of intent to terminate contract prematurely. Both employer and employee will both try to resolve any disagreement with all sincerity. (In some cases a teacher maybe given less notice by employer of termination in certain circumstances).
